GENERAL TERMS AND CONDITIONS-USA

The Terms of Use and Terms of Purchase (together, the “Terms and Conditions”) are governed by the laws of the state of Florida and the laws of the USA applicable therein unless the applicable laws of your state of residence requires that the laws of such state to govern, in which case, the laws of such state are to govern. The exclusive jurisdiction for any claim, action or dispute with Kuaigon LLC or relating in any way to your use of the Website or a purchase made on the Website will be in the courts of the state of Florida unless required otherwise by applicable laws of your state of residence. The parties hereby expressly agree to exclude the application of the United Nations Convention on Contracts for the International Sale of Goods as amended, replaced or re-enacted from time to time.

These Terms and Conditions, combined with any limited warranty provided with the product you purchase, the Privacy Policy and the terms and conditions respecting the financing of your purchase, if any (collectively, the “Contract”), constitute the entire agreement between you and Kuaigon with respect to your use of the Website and any purchase made by you on the Website and supersede all previous agreements, understandings and representations relating thereto. No failure by Kuaigon to exercise any rights, powers or remedies under the Contract or its delay to do so shall constitute a waiver of these rights, powers or remedies, and all waivers shall be in writing. The single or partial exercise of a right, power or remedy shall not prevent its subsequent exercise or the exercise of any other right, power or remedy. Kuaigon shall not be liable for any delay or failure to perform any of its obligations under the Contract if such delay or failure is due to causes beyond its control. You may not assign the Contract to any third party without the prior written consent of Kuaigon. It is the express wish of the parties that the Contract and all related documents be drawn up in English.

Information from Kuaigon products

We will collect information about your use of our connected products (for example, when they are used and for how long), their responsiveness and any errors (or potential errors) with them.

Some of the information we collect from your use of our connected products and apps will enable us to determine the location of your connected product. In particular, you will need to enable location tracking on your phone (or other device) when you first register your connected product (otherwise, we will not be able to connect it). It is useful for us to know your location so that we can understand the environmental conditions in which your connected product is operating which helps us to optimise the performance of the connected product.

Some of our connected products, or specific features of our connected products, may not be able to operate properly without collecting certain information.

 

Information from your online interactions

We will only send you marketing communications when you have told us that you are happy for us to do so.

If you have previously said that you would like us to contact you (“opted-in”) but would like to change or update the way that we do so, you can update your preferences by:

  • Contacting Kuaigon customer service and stating that you would like to change or update the way that we contact you; or
  • Logging onto your account on our website and changing your preferences and information.

 

What personal information do we share with third parties?

Most importantly, we never sell your personal data to anyone and only share it as outlined in this privacy policy or when you ask us to.

 

Third party service providers

We share your personal data with certain third-party service providers. They only have access to the personal data they need to perform those services. For example, your order and delivery details will be shared with our couriers. They are required to keep your personal data confidential and may not use it other than as we ask them to and always in accordance with this privacy policy. Those third-party service providers fall into the following categories:

  • Certain manufacturers, who produce the products in certain countries;
  • Those helping us to deliver products to you;
  • Third parties that help us with mailing services, product services and repairs, processing product purchases, financial services, audit services, administrative services, IT technologies (e.g. data storage), security services and insurance claims; and
  • Third parties that help us to provide services and responses to you.

 

Third parties that help us with our advertising and marketing

We want to make sure that our advertising and marketing is relevant and interesting to you and our other customers. That means that we work with third parties to help us to understand how well our online advertising works, or to reach people who are more interested in our products. They do this by setting cookies on our website (more information on this can be found in our cookies policy).

We will also share limited personal data (such as name and contact details) with:

  • social media platforms (such as Facebook), who serve our advertising on their platforms and
  • third party data providers and analytics companies, who perform data matching and/or data analysis on our behalf.

We share certain personal data with third parties who help us to detect and prevent fraudulent transactions. The information we share with those third parties includes some of the information that you share with us (such as, your contact details and information about the transaction), and some of the information from your online interactions (such as the IP address of your device). We will also share your personal data if we are required to do so by law, including in response to a legal process, such as a court order or subpoena, or to comply with other national, state, provincial or local laws.

Interaction of connected products with third party products

We have added functionality to some of our connected products which allows your product to interact with certain third-party products that you have in your home (such as Amazon Echo, otherwise known as Alexa). This functionality allows you to take full advantage of a ‘smart home’ environment. However, the products will only interact if you want them to, by enabling the relevant functionality.

If you choose to allow your connected product to interact with a third-party product, certain information (including potentially personal data) will need to be shared with the third-party product and the relevant third-party provider. Generally, we will need to share a unique reference number to connect the two products, and information about your product and how you use it. We only share the minimum amount of personal data that we need to, to enable the two products to interact. Details of how the third party uses your personal data (as well as any personal data which it collects through its own product) are set out in the third party’s privacy policy. You should carefully review third parties’ privacy policies before using their products, and before connecting them with your connected product. You can stop your connected product from sharing information with the third-party product by disabling the connection between the two.

We provide links to other websites which are not operated and controlled by Kuaigon. We have no control over and are not responsible for the content of those sites or how the third parties responsible for them collect and use your personal data. We do not endorse or make any representations about third party websites.

Third party websites usually have their own privacy policies explaining how they use and share your personal data. You should carefully review those privacy policies before you use these websites to make sure that you are happy with how your personal data is being collected and shared.

 

Children

Kuaigon’s websites, apps and products are not directed at children.

Where we knowingly collect and process children’s data, appropriate information about that processing will be provided at the point of collection. Parental, and or legal guardian, consent for this data will be collected at the time of data collection, as and when required.

RETURN AND REFUND POLICY-USA

Return Policy

Kuaigon’s Return Policy does not accept products that have been damaged caused by improper installation or improper use.

More specifically, the warranty does not cover:

  • Damage or problems caused by improper use, accident, alteration or electrical connection of improper intensity or voltage.
  • Modified products, those whose warranty seal or serial number have been damaged, alters, removed or oxidized.
  • Failure of the battery due to overcharging or failure to observe the safety instructions explained in the instruction manual.
  • Cosmetic damage, including scratches, dents or any other element.
  • Damage caused by any intervention carried out by an unauthorized person.
  • Defects caused by normal wear and tear or due to normal aging of the product.
  • Software updates due to a change in network settings.
  • Product failures due to the use of third-party software to modify, change or adapt the existing software.
  • Product failures caused by use without accessories approved by the manufacturer.
  • Oxidized products.

 

You must return the product with the accessories necessary for its proper operation (power supply, adapter, etc) in its original packaging for return.

In the event that your product is not eligible for return, but is covered by warranty, the after sales service may, within the limits of local law, either:

  1. Repair or replace the defective parts.
  2. Exchange the defective product with a product that has at least the same functionally and that is equivalent in terms of performance,
  3. Refund the product at the purchase price of the product mentioned on the proof of purchase.

 

Return Window

Kuaigon offers a return window of 30 days, which begins 7 days after an item’s ship date.

 

Return Eligibility

If the conditions of our return policy are met, customers can return items to the us by contacting the retailer or marketplace where they purchased the product.  Otherwise, a customer may contact us directly to assist in a return.
Returns in Stores

In some cases, you may return a product directly to the retail store, even if purchased online or from their marketplace.  Please see the eligibility requirements from where you purchased the product. If a customer chooses to return an item in store, the customer will package the item in a shipment-ready container and bring it to the store. An associate will receive the item, check return eligibility per Kuaigon’s rules, and if the item is eligible for return, affix a shipping label to the package. The retailer will then arrange the return shipment to the us.  All right, title, and interest in and to a returned item belongs to the Kuaigon from the moment the returned item is accepted at a store. Kuaigon is responsible for all risk of loss to the returned item except when the returned item is in the retailer’s care and control.
Refund Timing

For returns initiated in store, eligible customers will receive a refund on receipt of the item in store.

For returns initiated online or by phone, refunds will be issued to eligible customers when the return package is first scanned by the carrier.
